SECTION 1. Be it enacted by the General Assembly of
Maryland, That Section 40 of Article 63 of the Annotated
Code of Maryland (1951 Edition), title "Mechanics' Lien",
sub-title "Merchandise", be and it is hereby repealed and
re-enacted, with amendments, to read as follows:
40. Upon all articles of merchandise of every kind left
or given to artisans, tradesmen, mechanics, laborers or
other persons by the owner or by any other person with
his authority, express or implied, for repairing, mending,
improving, or other work thereon, the said artisans, trades-
men, mechanics, laborers or other persons shall have a lien
on said article or articles for cost of repairs, work on and
material put on or in such article. If [one year] ninety
days after the completion of repairs, work on or material
put on or in such article the indebtedness of any part
thereof remains unpaid and owing, such artisans, trades-
men, mechanics, laborers or other persons may after one
month's notice in writing to the owner of such article or
articles notifying such owner of the amount due, by mailing
such notice directed to the owner's last known address, or
if the owner be unknown, by written or printed notice set
up at the Court House door of the county or City of Balti-
more or by publication once a week for two successive
weeks in a newspaper of general circulation published in
the city or county in which said work has been done and
the bill remains unpaid, sell such article or articles at pub-
lic or private sale to satisfy such claim, and the proceeds
after paying expenses of such sale, be applied in liquida-
tion of such indebtedness, and the balance, if any, be paid
over to such debtor.
SEC. 2. And be it further enacted, That this Act shall
take effect June 1, 1954.
