State and the Federal Security Administrator entered into
under this sub-title; or (3) any services of an emergency
nature, any agricultural labor or service performed by a
student which is excluded from employment by any provi-
sion of Section 210(a) of the Social Security Act, other
than paragraph (8) of such section, services in any class
or classes of positions filled by popular election, or services
in any class or classes of positions the compensation for
which is on a fee basis, if expected EXCEPTED from cov-
erage in the plan submitted under Section 32.
(c) The term "employee" includes an officer of a politi-
cal sub-division of the State;
(d) The term "State Agency" means the Board of
Trustees of the Employees' Retirement System of the State
of Maryland created by this Article.

(e) The term "Federal Security Administrator" includes
any individual to whom the Federal Security Administra-
tor has delegated any of his functions under the Social
Security Act with respect to coverage under such Act of
employees of States and their political sub-divisions;
(f) The term "political sub-division" includes an instru-
mentality of the State, of one or more of its political sub-
divisions, or of the State and one or more of its political
sub-divisions, but only if such instrumentality is a juristic
entity which is legally separate and distinct from the State
or sub-division and only if its employees are not by virtue
of their relation to such juristic entity of the State of sub-

(g) The term "Social Security Act" means the Act of
Congress approved August 14, 1935, Chapter 531, 49
Statutes 620, officially cited as "The Social Security Act"
(including regulations and requirements issued pursuant
thereto), as such Act has been and may from time to time
be amended; and
(h) The term "Federal Insurance Contributions Act"
means sub-Chapter A of Chapter 9 of the Federal Internal
Revenue Code as such Code has been and may from time
to time be amended.
31. (Federal State Agreement), (a) The State Agency,
with the approval of the Governor, is hereby authorized
to enter on behalf of the State into an agreement with the
Federal Security Administrator, consistent with the terms
