CHAPTER 300
(Senate Bill 194)
AN ACT to repeal and re-enact, with amendments, Sec-
tion 5 of Article 39A of the Annotated Code of Maryland
(1939 Edition), title "Forestry, " providing that Forest
Wardens assigned to work in Patapsco State Forest
have the powers of peace officers and be provided with
uniforms and firearms.
WHEREAS, Patapsco State Forest is near Baltimore City
and densely populated suburban areas, as a result of which,
many persons use said State Forest; and
WHEREAS, Many acts of vandalism and disorderly con-
duct have been committed in said Forest and on proper-
ties bordering thereon; and
WHEREAS, on the further expansion of said State For-
est, there will be further opportunities for the commis-
sion of crime; and
WHEREAS, it is desirable that greater protection be
afforded those who use said Forest and those who live in
areas bordering thereon; therefor,
SECTION 1. Be it enacted by the General Assembly of Maryland,
That Section 5 of Article 39A of the Annotated Code of
Maryland, (1939 Edition) title "Forestry, " be and it is
hereby repealed and re-enacted, with amendments, to read
as follows:
5. (a) Whenever the State Forester considers it neces-
sary he may apply to the Governor to commission such
persons as he may designate to act as Forest Wardens of
this State, to enforce the forest laws and to carry out all
the purposes of this article, and any work that may be
assigned to them by the State Forester. If the Governor
approves such persons he may appoint them Forest War-
dens for a term of two years, but they shall be subject
to removal at any time at the pleasure of the Governor.
Such Wardens shall receive such compensation for their
