allowances or other disability or death benefits in any
such fund or system. Any such person, during such ab-
sence except as herein otherwise specified, shall retain his
status and rights as a member of any such pension or re-
tirement fund or system (a) if he does not withdraw any
part of his accumulated contributions, and (b) if within
one year from the time he is relieved from active duty or
service he shall again be actively employed by his employer
or employing unit at the time he left for active service,
and (c) if he shall not have previously taken any other
employment EXCEPT TEMPORARY EMPLOYMENT
AFTER HE HAS APPLIED FOR RE-EMPLOYMENT
IN HIS FORMER CLASSIFICATION OR POSITION IN
THE STATE SERVICE, AND HAS BEEN REFUSED
IMMEDIATE RE-EMPLOYMENT FOR CAUSES BE-
YOND HIS CONTROL; provided, however, that if such
person has withdrawn any part of his accumulated con-
tributions, he shall be entitled to repay the sum withdrawn
into the pension or retirement fund or system, including
the Teachers Retirement System of the State of Mary-
land, with regular interest thereon to the date of repay-
ment and, if otherwise qualified, be entitled to the benefits
of this Section as if such withdrawal had not been made.
If under the above restrictions any such person be again
actively employed by his said former employer or em-
ploying unit, OR RE-INSTATED AS A REGULAR EM-
PLOYEE ON A LEAVE OP ABSENCE, IN ANY POSI-
TION FOR WHICH MEMBERSHIP IN ANY PENSION
OR RETIREMENT FUND OR SYSTEM, INCLUDING
THE TEACHERS' RETIREMENT SYSTEM OF THE
STATE OF MARYLAND IS MADE A CONDITION OF
EMPLOYMENT within one year from the time he is
relieved from active duty, he shall receive credit as mem-
bership service for the period of his absence. During the
period of such absence of any person who was employed
by the State or any agency thereof, including teachers, at
the time he entered active service, the State or agency
thereof shall make its contribution on behalf of such em-
ployee as it would have made had he not been absent and
had retained his status as an employee during the period
of his absence and shall also make on behalf of such em-
ployee the contributions which such employee would have
made had he not been absent and had retained his status
as an employee during the period of his absence. Such
person, however, shall have no right to withdraw any part
of any such contribution made by the State or any agency.
