days previous to the election, and naming the date, hours and
place of election, and the judges who shall officiate thereat,
which judges or any two of whom shall hold such election and
perform the duties of judges in like manner and at like pay as
judges appointed by the Commissioners. The costs of such
elections shall be borne
by the Commissioners.

128. If any person elected to the office of Commissioner shall
refuse to act or to qualify, shall die, resign or he or become
disqualified or remove beyond the corporate limits of said
town, the remaining Commissioners shall within thirty days
elect a successor to serve until the next election, at which time
a Commissioner shall be
elected to fill the unexpired term
caused by such vacancy. If the Commissioners so remaining
shall fail to fill the vacancy as aforesaid within the time afore-
said, then the vacancy may be
filled by an election called by five
or more voters in the same manner and prosecuted as provided
in Section 127.

129. All officers of said town, including judges of election,
before they enter upon the duties of their
respective offices,
shall take oath before a Notary Public of Caroline County that
they will well and faithfully perform the duties of their re-
spective offices as prescribed by law and the ordinances of the
Commissioners, to the best of their skill and judgment without
fear, favor, partiality or prejudice. A certificate of such
qualification shall be delivered by such Notary Public to the
Commissioners to be filed and recorded among their proceed-
ings. A failure to qualify on or before the date specified for
taking office shall be deemed a refusal to accept the office to
which such person has been elected or appointed.

130. The said Commissioners at their first meeting after
election and qualification shall elect from their own number
a presiding officer of their Board, who shall be known as Mayor
and hold said office during the pleasure of the Board, and
shall appoint a Secretary and a Treasurer, which latter offices
may be held by the same person. The Commissioners may ap-
point one or more assessors of taxes and may appoint bailiffs
or police, who, within the limits of said Town and beyond them
within one mile thereof, shall have all the police powers of
constables and it shall be their duty to enforce the by-laws
and ordinances of the Town and the laws of the State of Mary-
land relating to crimes and misdemeanors. The Commissioners
may appoint such other officers and employees from time to
time as they may deem necessary for the interest and welfare
of said town, and determine the rates of pay of all persons
appointed.
