superintendent of a notice of appeal; provided that, in the dis-
cretion of the Court, any party, including the superintendent,
shall have the right to present any new or additional evidence
pertinent to the matter. The determination of the superin-
tendent shall be prima facie correct and the burden of proof
shall be on the appellant to show that the superintendent
acted fraudulently, arbitrarily or capriciously. The Court may
affirm, modify or reverse the determination of the superin-
tendent and the decision of the Court shall be final. No further
appeal shall lie to the Court of Appeals of Maryland.

91B. Should any Section or provision of this sub-title be
held to be invalid by any Court of competent jurisdiction, the
same shall not affect the validity of the sub-title as a whole
or any part thereof other than the portion so held to be invalid.

SEC. 3. And be it further enacted, That this Act shall take
effect June 1, 1951.

AN ACT to repeal and re-enact, with amendments, Sections
235A—235J, of Article 77 of the Annotated Code of
Maryland (1947 Supplement), title "Public Education, "
sub-title "University of Maryland, " as said sections were
enacted by Chapter 61 of the Acts of 1950, authorizing
the University of Maryland to construct buildings at
College Park and in Baltimore City to provide additional
facilities for students, to impose charges or fees for the
right of use thereof and authorizing the University of
Maryland to issue revenue bonds for the construction
of said buildings, the principal and interest of which to
be payable solely from the fees and charges for the right
to use of the buildings constructed with the proceeds
of said bonds except for interest prior to, during and
for one year after completion of construction, provided
that interest during such period may be paid out of
