providing that the salaries of the clerks to the State's Attor-
ney be fixed by the County Council.

SECTION 1. Be it enacted by the General Assembly of Mary-
land,
That Sub-sections (j) and (k) (8) of Section 37A of
Article 10 of the Annotated Code of Maryland (1947 Supple-
ment), title "Attorneys at Law and Attorneys in Fact", sub-
title "State's Attorney", said sub-sections having been amended
by Chapter 424 of the Acts of 1949, be and they are hereby
repealed and re-enacted, with amendments, to read as follows:

37A.

(j) The State's Attorney of Montgomery County shall re-
ceive an annual salary of f 7, 500. [The Assistant State's Attor-
ney shall be appointed by the State's Attorney and shall receive
a salary as set by the County Council of Montgomery County.
The salary of the State's Attorney shall include his services
before or on behalf of Justices of the Peace or Trial Magis-
trates of said County in preliminary hearings or trials in
criminal cases. ] The State's Attorney is hereby authorized
and empowered to appoint a Deputy State's Attorney who
shall receive an annual salary of not less than $5, 000. 00 and
an Assistant State's Attorney who shall receive an annual
salary of not less than $3, 600. 00. The County Council may
increase the compensation of the Deputy and Assistant State's
Attorney in its discretion. The State's Attorney and the Dep-
uty State's Attorney, or either of them, shall present cases to
the Grand Jury of Montgomery County, and perform such
other acts and duties in relation to said Grand Jury as are
necessary and proper. The salaries of the State's Attorney,
the Deputy and Assistant State's Attorneys shall include such
services as any of them perform before or on behalf of the
Judges of the Circuit Court, Justices of the Peace or Trial
Magistrates of said County, in preliminary hearings or trials
in criminal cases.

(8) The State's Attorney of Montgomery County is author-
ized to appoint two clerks at [a salary of not exceeding $125. 00
monthly for each] such annual salary as may be fixed by the
County Council.

SEC. 2. And be it further enacted, That this Act shall take
effect June 1, 1951.
