the Commissioners of Berwyn Heights shall notify each prop-
erty owner on the street or section thereof that is to be as-
sessed,
by mail and by advertising in one or more newspapers
that have general circulation in the Town of Berwyn Heights,
which advertising shall state the date on which such assess-
ment shall be made and warning all abutting owners to appear
at the time and place stated in said advertisement or notices,
to show cause, if any there be, why said assessment should not
be made as proposed. Any person aggrieved by the action of
the Commissioners of Berwyn Heights, shall have the right to
appeal to the Circuit Court for Prince George's County, Mary-
land, provided such appeal is taken within thirty days next
succeeding the day on which said assessment is made.

33F. When construction of streets, alleys, curbs, sidewalks
and gutters is authorized, the Commissioners of Berwyn
Heights shall invite proposals for said construction by adver-
tisement for two weeks in some newspaper having general cir-
culation in the Town of Berwyn Heights, and the Commis-
sioners shall, in all cases award the contract for such construc-
tion to the lowest responsible bidder therefor, reserving at all
times the right to reject any and all bids received. All con-
tractors for such construction shall give bond in such sums as
the Commissioners shall require with sufficient surety or sure-
ties, to be approved by the Commissioners for the faithful per-
formance of their contract.

SEC. 2. And be it further enacted, That the provisions of this
Act shall not become effective until it shall have been sub-
mitted to the qualified voters of the Town of Berwyn Heights
at a special election to be held on Wednesday, May 9. 1951.
TUESDAY, MAY 6, 1952. There shall be printed on the
ballots to be used at said election, the title of this Act
and underneath said title, on separate lines, a box or square
to the right of and opposite the words "For Special Assess-
ments for Street Improvements", and a corresponding box
or square to the right of and opposite the words "Against
Special Assessments for Street Improvements", so that the
voters shall be able to designate by a cross mark, in the
proper box or square, his or her decision for or against
said special assessments. If a majority of the votes cast
on said question shall be "For Special Assessments for
Street Improvements", then this Act shall become immediately
effective. If a majority of the votes cast shall be "Against
Special Assessments for Street Improvements", then this Act
shall be null and void and of no effect whatsoever.

SEC. 3. And be it further enacted, That this Act is hereby
declared to be an emergency measure and necessary for the
