Dear Mr. Speaker:


I am returning House Bill No. 342 without my approval be-
cause I believe the supplementing of State payments to retired
teachers should be dealt with in the annual budgets and not in
special legislation.

Such appropriations should be subject to existing economic
conditions in the period for which the budget is being prepared,
and to the State's financial situation at the time.

As you know, I recommended and the Legislature approved
appropriations of $100, 000. in the original budget for the next
fiscal year, and $83, 351 in the supplemental budget to supple-
ment existing pensions for retired teachers in the counties
and in Baltimore City.

I am confident that each succeeding Legislature will make
such provisions in future budgets as are deemed necessary.

POLICE MAGISTRATES

Dear Mr. President:


Senate Bill No. 439 provides that the right of removal
authority as to trial magistrates in the counties, shall also
apply to the Police Magistrates in the several station houses in
Baltimore City. Although the wisdom of the existing right
of removal in the counties may well be questioned, it should
be noted that County Trial Magistrates exercise both civil and
criminal jurisdiction. In a number of counties their jurisdic-
tion in civil cases extends well in excess of $100. The Balti-
more City Police Magistrates have jurisdiction only in crimi-
nal cases.
