(c) Dispose of any rejected or condemned weight or
measure in a manner contrary to law or regulation.
(d) Remove from any weight or measure, contrary to
law or regulation, any tag or mark placed thereon by the
superintendent, his deputy, or one of his inspectors, OR
ANY INSPECTOR, or a sealer or deputy sealer.
(e) Sell, or offer or expose for sale, less than the quan-
tity he represents of any commodity, thing, or service.
(f) Take more than the quantity he represents of any
commodity, thing, or service when, as buyer, he furnishes
the weight or measure by means of which the amount of
the commodity, thing, or service is determined.
(g) Keep for the purpose of sale, advertise or offer or
expose for sale, or sell any commodity, thing, or service
in a condition or manner contrary to this law or regula-
tions issued thereunder.
(h) Use in retail trade, except in the preparation of
packages put up in advance of sale and of medical pre-
scriptions, a weight or measure which is not so positioned
that its indications may be accurately read and the weigh-
ing or measuring operation observed from some position
which may reasonably be assumed by a customer.
(i) Violate any provision of this act or of the regula-
tions promulgated under the provisions of this Act, for
which a specific penalty has not been prescribed.
31-D. Import of Terms. — (1) that the word "person"
as used in this Act shall be construed to import both the
plural and singular, as the case demands, and shall include
individuals, partnerships, corporations, companies, socie-
ties, and associations.
(2) The words "weight(s) and/or measure(s)" shall
be construed to import all weights and measures of every
kind, instruments and devices for weighing and measur-
ing, and any applicances and accessories associated with
any or all such instruments and devices.
(3) The words "sell" and "sale" shall be construed to
import barter and exchange.
31-E. The State Superintendent of weights and meas-
ures, his deputy and inspectors, OR ANY INSPECTOR,
shall not exercise any authority with respect to administra-
tion and enforcement within Baltimore City, which has its
own inspection system, but the other provisions hereof
shall apply to said City.
