AN ACT to repeal and re-enact, with amendments, Sections 62
and 63B of Article 39 of the Annotated Code of Maryland
(1947 Supplement), title "Fish and Fisheries", sub-title
"Licenses", relating to the manner of issuance and the fees
of certain licenses for the taking of fin fish for commercial
purposes.
SECTION 1. Be it enacted by the General Assembly of Mary-
land, That Sections 62 and 63B of Article 39 of the Annotated
Code of Maryland (1947 Supplement), title "Fish and Fish-
eries", sub-title "Licenses", be and they are hereby repealed
and re-enacted, with amendments, to read as follows:
62. (When Additional Licenses may be issued. ) Prior to
December 1st 1941, and prior to December 1st in each succeed-
ing year, the Commission of Tidewater Fisheries shall make an
estimate of the quantity of marketable fin fish of every species
(except eels) that may be available during the succeeding
license year and of the number and types of nets that may be
profitably employed without injury to the fishery. If the Com-
mission shall determine that additional nets for the taking of
fin fish (except eels) should be licensed, over and above the
number actually applied for prior to December 1st, then it
shall give public notice, by advertisement once a week for two
successive weeks in one or more newspapers of general circula-
tion in the county or counties in which the licenses will be
issued, of the number of additional nets that may be licensed
and of the areas where the same may be operated and shall
state that applications will be received up to a date to be set
by the Commission. An applicant to qualify for a license must
have been issued a license for catching crabs or oysters for two
preceding years with catch records or sales records proving
that he was engaged in the catching of seafood, or shall submit
proof to the Commission that he has been engaged in or em-
ployed in the business of catching fish commercially for two
years. He shall further present proof satisfactory to the Com-
mission that the catching of seafood has been his principal
occupation for the past two years during the normal fishing-
