AN ACT to repeal Sections 123 to 127A, inclusive, of Article 11
of the Code of Public Local Laws of Maryland (1930 Edi-
tion), title "Frederick County", sub-title "Roads", as said
sections were enacted by Chapter 633 of the Acts of 1947,
and to enact in lieu thereof six new sections to be known as
Section 123 to 127A, inclusive, providing for a County Roads
Board and County Roads Engineer, and prescribing their
duties and powers, along with those of the County Commis-
sioners, in relation to the county roads of Frederick County.
SECTION 1. Be it enacted by the General Assembly of Mary-
land, That Sections 123 to 127A, inclusive, of Article 11 of the
Code of Public Local Laws of Maryland (1930 Edition), title
"Frederick County", sub-title "Roads", as said sections were
enacted by Chapter 633 of the Acts of 1947, be and they are
hereby repealed and that six new sections be and they are
hereby enacted in lieu thereof, said new sections to be known
as Sections 123 to 127A, inclusive, to read as follows:
123. (a) In order to assist the County Roads Engineer in for-
mulating road maintenance and construction programs, a
County Roads Board for Frederick County is hereby created.
The appointed members of said Board shall advise the County
Commissioners as to any and all matters pertaining to the
county roads, including, but not limited to, matters concerning
the planning, construction, repair, and maintenance of county
roads or the need thereof.
(b) The Board shall consist of eight (8) members, five of
whom shall serve without salary for a term beginning May 1,
1950, and which shall be constituted as follows: Dr. John
Messier for a term of one year; Avery Browning for a term of
two years; Lewis J. Martz for a term of three years; William
Staley for a term of four years; and Austin P. Renn for a term
of five years; the remaining three members shall be the County
Commissioners of Frederick County. The Chairman of the
Board shall be Chairman of the County Commissioners from
among the members of the Board. THE PRESIDENT OF
THE BOARD OF COUNTY COMMISSIONERS SHALL BE
EX OFFICIO CHAIRMAN OF THE COUNTY ROADS
BOARD.
