part of any common boundary between the State of Mary-
land and any adjacent state, commonwealth or district;
provided, however, that in any resurvey the present estab-
lished boundaries of this State shall be preserved with the
greatest possible fidelity.

The Board of Natural Resources and its component de-
partments, and the authorized agents and employees of the
Board, are hereby authorized and empowered to enter upon
any property, public or private, for the purpose of examin-
ing any boundary monument; provided, however, that this
Section shall not authorize the Board or its agents or de-
partments to enter during the growing season upon any
land planted to crops which might be damaged by such
entry.

23. Any person or persons who shall move, remove,
break, mutilate, deface destroy, or otherwise injure any
monument or monuments marking any boundary between
the State of Maryland and any adjacent state, common-
wealth or district shall be guilty of a misdemeanor and
upon conviction thereof shall be fined fifty dollars ($50. 00)
for each and every offense. Any person or persons who
shall have in his or their possession any monument hereto-
fore placed, or prepared to be placed, upon any boundary
of this State shall, upon demand being made for the same
by the Board of Natural Resources, surrender and deliver
the same to the said Board or to one of the constituent de-
partments, agents or employees of the said Board, and upon
failure of any such person or persons to surrender and de-
liver such monuments as hereinbefore required, such per-
son shall be guilty of a misdemeanor and upon conviction
thereof shall be fined fifty dollars ($50. 00) for each and
every offense. The officers of the Board of Natural Re-
sources, and the full-time game wardens, forest wardens
and other officers of the component departments of the
Board, are hereby invested with the powers of arrest and
with other powers necessary to the enforcements of this
Section. Nothing in this Section shall be construed to re-
quire either the Maryland Historical Society or the Histor-
ical Society of Pennsylvania to surrender or deliver to the
Board of Natural Resources the Mason and Dixon monu-
ment placed in the custody of each of the said Societies by
the mutual consent of the State of Maryland and the Com-
monwealth of Pennsylvania in 1902.

SEC. 3. And be it further enacted, That this Act shall
take effect June 1, 1951.
