thereof, inclusive, shall not exceed more than one to every
1300 persons residing in Allegany County as determined
by the last U. S. Census.
[In issuing the licenses for the license year beginning
May 1, 1947, said Board shall re-issue a license of the same
character to the persons now holding such licenses if such
persons apply for the same and if such persons have not
been guilty of violating the liquor laws of Allegany County
during the past year, and are otherwise qualified to receive
such licenses. ]
37. (E) THE NUMBER OF CLASS C, OR CLUB,
LICENSES ISSUED FOR THE RETAIL SALE OF AL-
COHOLIC BEVERAGES IN ALLEGANY COUNTY
SHALL NOT AT ANY TIME EXCEED SIXTY (60). IF
AT ANY TIME A LICENSE HELD BY A CLUB UNDER
THE PROVISIONS OF THIS ARTICLE SHALL BE RE-
VOKED OR SURRENDERED, THE TOTAL NUMBER
OF SUCH CLUB LICENSES SHALL BE PERMANENT-
LY REDUCED AND NO OTHER SIMILAR CLUB
LICENSE SHALL BE ISSUED IN PLACE OF THE
LICENSE SO REVOKED OR SURRENDERED.
(F) THE BOARD SHALL HAVE FULL POWER
AND AUTHORITY TO LIMIT AND RESTRICT THE
NUMBER OF LICENSES WHICH THEY SHALL CON-
SIDER SUFFICIENT FOR ANY NEIGHBORHOOD, TO
REGULATE AND LIMIT THE USE OF MECHANICAL
MUSIC BOXES AND OTHER SOUND MAKING DE-
VICES AND TO PRESCRIBE AREAS IN WHICH NO
LICENSES SHALL BE ISSUED. ANY APPLICANT
OR LICENSEE FEELING AGGRIEVED BY ANY LIMI-
TATION, RESTRICTION OR PROHIBITION IMPOSED
BY ANY SUCH BOARD SHALL BE ENTITLED TO
APPEAL AS HEREINAFTER PROVIDED.
45. (B) ALLEGANY COUNTY. IN ALLEGANY
COUNTY THE APPLICATION SHALL ALSO CON-
TAIN (1) A STATEMENT THAT THE APPLICANT
IS NOT LESS THAN TWENTY-ONE YEARS OF AGE;
(2) A STATEMENT BY THE APPLICANT THAT AS
A CONDITION FOR THE ISSUANCE AND/OR CON-
TINUANCE OF SAID LICENSE HE WILL PRODUCE
ALL RECORDS REQUIRED TO BE KEPT UNDER THE
PROVISIONS OF THIS ARTICLE TO THE COMP-
TROLLER, HIS DEPUTIES OR THE SHERIFF OF
ALLEGANY COUNTY OR THE POLICE OFFICERS
OF ANY MUNICIPAL CORPORATION THEREIN, OR
AS MAY BE REQUIRED IN ANY PROCEEDING BE-
