AN ACT to repeal and re-enact, with amendments, Section
72 of Article 39 of the Annotated Code of Maryland
(1939 Edition), title "Fish and Fisheries, " sub-title
"Concurrent Law on the Potomac River, " extending
the time permitted for gill net fishing in Charles County.
SECTION 1. Be it enacted by the General Assembly of Maryland,
That Section 72 of Article 39 of the Annotated Code of
Maryland (1939 Edition), title "Fish and Fisheries, " sub-
title "Concurrent Law on the Potomac River, " be and it
is hereby repealed and re-enacted, with amendments, to
read as follows:
72. The use of any sunken anchored gill net is abso-
lutely prohibited in the waters of the Potomac River at all
times, and the use of all gill nets known as floating or drift
nets and all stake gill nets is prohibited at all times of the
year except during the shad and herring season and in
Charles County, AND ST. MARY'S COUNTIES, Mary-
land, except in October, November and December. AND
NOVEMBER. Any person, firm or corporation violating
the provisions of this section shall on conviction thereof
before any justice of the peace of any county of this State,
most accessible, forfeit said net or nets, or device, together
with all boats, vessels and tackle used in the violation of
this section and be fined a sum of not less than Three
Hundred Dollars and not more than One Thousand Dollars,
or to be subject to both fine and forfeiture, in the discre-
tion of the justice of the peace trying the same.
SEC. 2. And be it further enacted, That the provisions
of this Act shall not take effect until a similar act becomes
effective in the State of Virginia, whereupon the Governor
of Maryland shall issue a proclamation declaring the pro-
visions of this Act to, be effective.
SEC. 3. And be it further enacted, That this Act shall
take effect June 1, 1951.
