CHAPTER 538
(Senate Bill 323)

AN ACT to repeal Sections 209 to 261, inclusive, of Ar-
ticle 7 and Sections 557 to 608, inclusive, of Article 11
of the Code of Public Local Laws of Maryland (1930
Edition), titles "Carroll County, " and "Frederick Coun-
ty/' respectively, sub-title "Mt. Airy, " said sections be-
inig; the corporate charter of the Town of Mt. Airy; to
repeal all amendments thereof or additions thereto; and
to add 111 new sections to stand in the place and stead
of the sections so repealed, revising the corporate
charter for the Town of Mt. Airy, and providing for a
referendum thereon.

SECTION 1. Be it enacted by the General Assembly of Maryland,
That Sections 209 to 261, inclusive, of Article 7 and Sec-
tions 557 to 608, inclusive, of Article 11 of the Code of
Public Local Laws of Maryland (1930 Edition), titles
"Carroll County, " and "Frederick County, " respectively,
sub-title "Mt. Airy, " and all amendments and additions
thereto, be and they are hereby repealed and that 111 new
sections be and they are hereby added to said Articles, said
new sections to stand in the place and stead of the sections
so repealed, to read as follows:

ARTICLE I

INCORPORATION AND GENERAL GOVERNMENT
INCORPORATION

1. The inhabitants of the Town of Mount Airy, in
Carroll and Frederick Counties, Maryland are hereby con-
stituted a body corporate by the name of "The Town of
Mount Airy, " and by that name shall have perpetual suc-
cession, sue and be sued, have and use a common seal which
may be altered at pleasure, and have all powers and privi-
leges incident to or that may attach to a municipal corpora-
tion. The repealing of the former Section 209 of Article 7
and the former Section 557 of Article 11 of the 1930 edi-
tion of the Code of Public Local Laws of Maryland, and
the enactment of this new section, shall not be construed as
terminating the existence of the corporation known as the
"Mayor and Council of Mt. Airy, " and creating a new cor-
poration by the name of "The Town of Mount Airy, " but
shall be construed as continuing the existence of the cor-
poration known as the "Mayor and Council of Mt. Airy"
and changing its name to that of "The Town of Mount
Airy. "
