CHAPTER 477
(House Bill 64)

AN ACT to repeal and re-enact, with amendments, Section 10
of the Charter of the City of Cumberland (1950 Edition,
being Article 1A of the Code of Public Local Laws of Mary-
land), title "City of Cumberland, " sub-title "Elections, "
relating to the requirements for submitting a statement of
candidacy for the office of either City Councilman or Mayor
of the City of Cumberland.

SECTION 1. Be it enacted by the General Assembly of Mary-
land,
That Section 10 of the Charter of the City of Cumberland
(1950 Edition, being Article 1A of the Code of Public Local
Laws of Maryland), title "City of Cumberland, " sub-title
"Elections, " be and it is hereby repealed and re-enacted, with
amendments, to read as follows:

10. (a) Candidates to be voted for at all general municipal
elections at which a Mayor and City Councilmen are to be
elected, under the provisions of this Article, shall be nominated
by a primary election, and no other name shall be placed on the
general ballot except those selected in the manner hereinafter
prescribed. The primary election for such nomination shall be
held on the second Tuesday preceding the general municipal
election. The judges appointed for the general municipal elec-
tion shall be the judges of the primary election, and the polls
shall be opened and closed at the same hours and with the
same clerks as are required for the general municipal election.
Any person desiring to become a candidate for Mayor or City
Council shall, at least ten days prior to said primary election,
file, or there shall be filed for Mm, with the City Clerk a state-
ment of such candidacy in substantially the following form:
Candidate for Nomination for.............................

State of Maryland, Allegany County:

I,..................... being first duly sworn, say that

I (or he) reside at................ Street, City of Cumber-
land, County of Allegany, State of Maryland; that I (or he)
am (or is) a qualified voter therein; that I (or he) am (or is)
qualified to hold; that I (or he) have (or has) resided within
the City for at least five years preceding the election;
that I
(or he) am (or is) a candidate for nomination to the office
of.............. to be voted upon at the primary election to

be held on the.......... day of.......... 19.., and I

hereby request that my (or his) name be printed upon the
official primary ballot for a nomination by such primary
election for such office.
