AN ACT to add a new section to Article 27 of the Anno-
tated Code of Maryland (1939 Edition), title "Crimes
and Punishments", said new section to be known as Sec-
tion 352A, to follow immediately after Section 352 of
said Article and to be under the sub-title "Health—
Narcotic Drugs", providing that any motor vehicle or
other vehicle, vessel or aircraft used in the concealment,
conveying or transporting of narcotic drugs or in the
violation of any laws in said sub-title, shall be forfeited
to the county or to Baltimore City upon any conviction
for such offense and relating further to the use or dis
position to be made of such vehicle, vessel or aircraft.
SECTION 1. Be it enacted by the General Assembly of Maryland,
That a new section be and it is hereby added to Article 27
of the Annotated Code of Maryland (1939 Edition), title
"Crimes and Punishments", said new section to be known
as Section 352A, to follow immediately after Section 352
of said Article, and to be under the sub-title "Health—
Narcotic Drugs", and to read as follows:
352A. In addition to any other fines or penalties pro-
vided for a violation of the provisions of this sub-title, any
motor vehicle or other vehicle, vessel or aircraft used or
employed in the concealment, conveying or transporting
of any such narcotic drugs, or used during the course of
any violation of this sub-title by any person or persons
convicted of the same, shall upon the conviction or con-
victions be declared by the Court to be forfeited to the
county or to Baltimore City, as the case may be.; PRO-
VIDED THAT NO VEHICLE SHALL BE FORFEITED
HEREUNDER UNLESS THE OWNER THEREOF
AUTHORIZED OR PERMITTED SUCH USE OR EM-
PLOYMENT. The County Commissioners or the Mayor
and City Council of Baltimore at their discretion may use
the said vehicle for public purposes or may exchange, sell
or convey it to another person or persons; and any cash
or moneys received therefor shall be added to the general
funds of the county or City of Baltimore.
