guilty thereof shall be imprisoned for a term of not less
than five nor more than twenty years, and shall be subject
to a fine as provided for hereinabove in this section. Pro-
vided, further that if any such offense shall consist solely
of the possession of narcotic drugs in such quantities that
would indicate their use in the sale of said drugs in viola-
tion of the provisions of this sub-title, the offender shall,
upon conviction, be imprisoned not less than eighteen
months nor more than five years, and shall be subject to a
fine as hereinabove provided. Provided, further, that if
any such offense shall consist solely of the possession of
marihuana in violation of the provisions of this sub title,
the offender shall, upon conviction, be punished for the first
offense by imprisonment for not less than six months nor
more than two years, and shall be subject to a fine as here-
inabove provided; and for any subsequent offense, the
aforegoing provisions of this section shall apply.
SEC. 2. And be it further enacted, That this Act shall
take effect June 1, 1951.

AN ACT TO repeal Sections 36, 37, 38, 39, 40, 41, 42, 43,
44, 45 and 46 of the Charter of the City of Cumberland,
Maryland (1950 Edition, being Article 1A of the Code
of Public Local Laws of Maryland), title "Cumber-
land, " sub title "Civil Service—Police and Fire, " and
to enact in lieu thereof a new section to be under a new
sub-title "Police and Fire Departments, "—said new sec-
tion to be known as Section 36 and to follow immediately
after Section 35 of said Charter, providing for the estab-
lishment and maintenance of the Police and Fire De-
partments and setting forth the duties of the Chiefs of
said Departments, and a new section under a new sub-
title "Civil Service, " said new section to be known as
Section 37, and to follow immediately after Section 36,
providing for the establishment of a Civil Service Com-
