to contract specially with the owners of multi-family structures
and commercial property for the collection and disposal of said
refuse; said refuse collection and disposal service to be
estab-
lished and maintained by said Mayor and Common Council of
College Park, Maryland, either as a municipal operation or by
contract with such person, firm or corporation as may be satis-
factory to the said Mayor and Common Council of College
Park, Maryland, and the said Mayor and Common Council are
hereby authorized and empowered to pass such ordinances as
they may deem necessary from time to time in order to provide
for the proper collection and disposal of said refuse and to pre-
scribe such penalties for the violation thereof as they may now
prescribe for the violation of town ordinances. Said Mayor
and Common Council are hereby authorized and empowered to
levy and collect the special assessment provided for in this sub-
section in the same manner provided in the Charter of the
Town of College Park and amendments thereto for the collec-
tion of taxes in College Park. The money realized from such
special assessment shall be kept by the Town Clerk and Treas-
urer of College Park in a special fund and shall be used for no
purposes other than that specified in this title. Any surplus
arising from such assessment in any year shall be considered
by the Mayor and Common Council in making the levy for the
succeeding year and such surplus shall be used, together with
the money realized from the new levy, for the purposes set
forth in this sub-title.

SEC. 2. And be it further enacted, That before any special
assessment for the collection and disposal of refuse, the ques-
tion of such special assessment shall first be submitted to the
legally qualified voters of the Town of College Park of Prince
George's County at the next Town election to be held May 7,
1951. There shall be printed on the ballot to be used at said
election the title of this Act and underneath said title, on
separate lines, a square or box to the right of and opposite the
words "For Special Refuse Assessment", and a corresponding
square or box to the right of and opposite the words "Against
Special Refuse Assessment", so that the voters shall be able
to designate by a crossmark in the proper square or box his
or her decision for or against said special assessment. If a
majority of the votes cast at the said Town election shall be
"For Special Refuse Assessment", then said special refuse
assessment shall be levied and collected in accordance with the
provisions of this Act, but if a majority of the votes cast shall
be "Against Special Refuse Assessment", then this Act shall
be of no effect and shall be null and void.

SEC. 3. And be it further enacted, That this Act is hereby
declared to be an emergency measure and necessary for the
