(Senate Bill 309)
AN ACT to add a new section to Article 27 of the Annotated
Code of Maryland (1947 Supplement), title "Crimes
and Punishments", said new section to be known as
Section 436B, to be under the new sub-title "Manufac-
tured Articles", and to follow immediately after Section
436A of said Article, relating to the removal of serial
numbers from any manufactured article.
SECTION 1. Be it enacted by the General Assembly of Maryland,
That a new section be and it is hereby added to Article 27
of the Annotated Code of Maryland (1947 Supplement),
title "Crimes and Punishments", said new section to be
known as Section 436B, to be under the new sub-title
"Manufactured Articles", and to follow immediately after
Section 436A of said Article, and to read as follows:
436B. (a) It shall be unlawful for any person to re-
move, deface or obliterate any manufacturer's serial num-
ber punched or affixed by plate to any manufactured
article or product where the intent or purpose is to prevent
the tracing or identification of said article or product.
(b) It shall be unlawful for any person KNOWINGLY
to retain in his possession or to offer for sale any manufac-
tured article or product from which the manufacturer's
serial number has been SO removed, defaced or obliterated.
if said article or product is the current model being manu-
factured or offered by the manufacturer at that time.
(c) Any person who violates any provision of this sec-
tion shall be deemed guilty of a misdemeanor and upon
conviction thereof shall be fined not more than $300. 00 or
imprisoned not exceeding one year or be both fined and
imprisoned for each and every offense.
SEC. 2. And be it further enacted, That this Act shall
take effect June 1, 1951.
