gates, notwithstanding the objections of the Governor, by
a vote of 99 to 17 on February 7, 1952, and by the Senate
by a vote of 25 to 1 on February 8, 1952. Under the Con-
stitution, this Act will become effective June
1, 1952.

CHAPTER 3

(House Bill 341)

AN ACT to repeal and re-enact, with amendments, Sub-
section (4) of Section 97 of Article 77 of the Annotated
Code of Maryland (1939 Edition), title "Public Edu-
cation," sub-title "Teachers' Retirement System," per-
mitting any person eligible for membership in the Mary-
land State Teachers' Retirement System and who did not
elect to become a member within one year of the estab-
lishment of the system, to join the system and receive
pension credit, PROVIDED SUCH PERSON MAKES
AN ELECTION TO BECOME A MEMBER BETWEEN
JULY 1, 1951, AND DECEMBER 31, 1951, BOTH
DATES INCLUSIVE.

SECTION 1. Be it enacted by the General Assembly of
Maryland, That Sub-section (4) of Section 97 of Article 77
of the Annotated Code of Maryland (1939 Edition), title
"Public Education," sub-title, "Teachers' Retirement Sys-
tem," be and the same is hereby repealed and re-enacted,
with amendments, to read as follows:

97.

(4) A teacher whose membership in the retirement sys-
tem is contingent on his own election and who elects not to
become a member, may thereafter apply for and be ad-
mitted to membership [; but no such teacher shall receive
prior service credit unless he becomes a member within the
first year following the establishment of the retirement sys-
tem.] BETWEEN JULY 1, 1951, AND DECEMBER 31,
1951, BOTH DATES INCLUSIVE, AND WHO HAS
BEEN EMPLOYED AS A TEACHER CONTINUOUSLY
SINCE THE TIME HE OR SHE WAS FIRST ELIGIBLE
