CHAPTER 2
(House Bill 340)
AN ACT to repeal and re-enact, with amendments, Sub-sec-
tion (4) (b) of Section 99, of Article 77 of the Annotated
Code of Maryland (1947 Supplement), title "Public Edu-
cation," sub-title "Teachers' Retirement System," ad-
justing the benefits allowed those teachers retired on
disability.
Section 1. Be it enacted by the General Assembly of
Maryland, That Sub-section (4) (b) of Section 99 of
Article 77, of the Annotated Code of Maryland, (1947 Sup-
plement), title "Public Education," sub-title, "Teachers7
Retirement System," be and the same is hereby repealed
and re-enacted, with amendments to read as follows:
99.
(4) (b) A pension which, together with his annuity,
shall provide a total retirement allowance equal to [ninety
per centum of] one-seventieth of his average final com-
pensation multiplied by the number of years of his credi-
table service, if such retirement allowance exceeds one-
quarter of his average final compensation; otherwise a
pension which, together with his annuity, shall provide a
total retirement allowance equal to one-quarter of his aver-
age final compensation, provided, however, that no such al-
lowance shall exceed [ninety per centum of] one-seventieth
of his average final compensation multiplied by the number
of years which would be creditable to him were his service
to continue until the attainment of age 60.
Sec. 2. And be it further enacted. That this Act shall
take effect June 1, 1951.
This bill was passed at the 1951 session of the General
Assembly and was vetoed by the Governor on April 27,
1951. Under Section 17, Article 2 of the State Constitution,
as amended by Chapter 714 of the Acts of 1949, bills vetoed
after adjournment of the Legislature must be returned by
the Governor to the next regular or special session of the
Legislature. This bill was passed by the House of Dele-
