CHAPTER 42
(Senate Bill 89)

AN ACT to add a new Section to Article 75C of the Anno-
tated Code of Maryland (1947 Supplement), title "Pro-
hibited Actions," said new Section to be known as
Section 6A and to follow immediately after Section 6 of
this Article, prohibiting actions against any person who
voluntarily and without compensation permits the Civil
Defense authorities to use real estate or premises for
sheltering persons.

Whereas, by Chapter 653 of the Acts of 1952 the Gen-
eral Assembly of Maryland made the State Civil Defense
Agency a separate and independent agency of the State
and designated the Director of Civil Defense as the Admin-
istrator of said Act, and further authorized and directed
political subdivisions of this State to establish certain local
organizations for Civil Defense; and

Whereas, many persons owning or controlling real
estate or other premises will voluntarily and without com-
pensation permit the use of such premises as shelter but
who will be reluctant to do so unless immune from suit or
claim arising therefrom; therefore

Section 1. Be it enacted by the General Assembly of
Maryland,
That a new Section be and it is hereby added to
Article 75C of the Annotated Code of Maryland (1947
Supplement), title "Prohibited Actions," said new Section
to be known as Section 6A, to follow immediately after Sec-
tion 6 of said Article, and to read as follows:

6A. (Freedom from suit bestowed on owners or occu-
pants of property in certain cases.) No action shall be
brought or maintained against any person, firm, or cor-
poration owning, controlling or occupying any real estate
or other premises who shall permit said premises to be used
without charge or compensation for sheltering persons
during an attack or raid by an enemy or during a practice
attack or raid, to recover damages for personal injuries to
or the death of any person while on said premises during
an actual or practice attack or raid or for the loss or
destruction of personal property taken upon said premises
