1837.

four of them, shall thereafter exercise all the powers,
rights and privileges, and shall perform all the duties
required by the existing laws to be performed by the
said justices of the levy court of Somerset county;
and no appointment of justices of the levy court shall
hereafter be made, and all the powers lawfully exer-
cised by or vested in the commissioners of the tax for
Somerset county, and all the duties required by law to
be performed by them, shall be vested in and exercised
and performed by the said commissioners for Somerset
county, after they shall have become qualified as afore-
said.

CHAP. 87.

SEC. 5. And be it enacted, That the commissioners
for Somerset county shall, at their annual meeting,
appoint a fit and proper person, who shall transact all
business, and discharge all the duties now appertain-
ing to the several and respective officers of clerk of
the levy court and commissioners of the tax, in the
same manner as the clerk of Somerset county and the
clerk of the commissioners of the tax for said county
are now by law severally authorised and required to
transact the same; and the person so appointed, shall,
before he enters upon the duties of his office, execute a
bond to the State of Maryland, to be approved by the
said commissioners, in the penalty of two thousand
dollars, conditioned for the true and faithful perform-
ance of the several and respective duties hereby im-
posed: which bond shall be recorder! in the clerk's of-
fice of the county court of said county, and a copy
thereof, under the seal of the said court, shall be as
sufficient evidence as the original; and the said clerk,

when appointed, shall also take and subscribe the fol-
lowing oath or affirmation, as the case may be, to wit:
I, A. B. do swear (or affirm) that, as clerk of the com-
missioners for Somerset county, I will honestly and
faithfully, to the best of my skill and judgment, exe-
cute the duties of said office, without favor, affection
or prejudice. So help me God. Which oath or affir-
mation, any one of said commissioners is hereby au-

jected to the same penalties and forfeitures for non-
performance or neglect of official duty, as are prescri-
bed by the existing laws in relation as well to the
