will and testament; and that the said Mary Charles,
did consent that the said executor should sell said real
estate, clear and free of her right of dower, to which
she was legally entitled, believing by so doing that it
would redound to the benefit of all parties interested,
and believing at the same time that the Orphan's court
of Caroline county, were legally authorised to allow
her such portion of the proceeds of the sale, of the
same, as they might deem equivalent to her dower,
the court having declared that they had no jurisdiction
in the matter: — Therefore,

CHAP 4.

Be it enacted by the General Assembly of Maryland,
That the justices of the Orphan's court of Caroline
county, be, and they are hereby authorised and em-
powered, at their next meeting or as soon thereafter as
practicable, to allow to Mary Charles, widow of Le-
vin Charles late of said county, deceased, such portion
of the proceeds of the sale, of certain lands in Dor-
chester county, of which the said Levin Charles died,
seized, and possessed, and which by his last will and
testament, he authorised and empowered his executor,
Thomas H. Baynard to sell, and dispose of, as they in
their judgment may deem equivalent to her dower in
said real estate to which she was legally entitled, ta-
king into consideration, her health and age, any law
or usage to the contrary notwithstanding.

An additional supplement to the act, entitled, an act to
Incorporate the Baltimore and Fort Deposite Rail
Road Company, passed at December session, eigh-
teen hundred and thirty-one, chapter two hundred and
eighty-eight.

Be it enacted by the General Assembly of Maryland,
That the Baltimore and Port Deposite Rail Road
Company, be, and they are hereby released from all
obligation to construct a rail road from Havre de Grace
to Port Deposite; and the State reserves to itself the
power to incorporate any other company for that pur-
