Witting offenders, keeping the place, of holding said

election, of taking said registries clear of a crowd,
and making them easy of access to the legal voters,
under a penalty of fifty dollars, and it shall be the
duty of the warden of the jail of said city or county
to receive, and safe keep any offender, committed by
said registers and judges of elections, until discharg-
ed in due course of law.

SEC. 22. And be it enacted, That in case any vacan-
cy, or vacancies shall occur in the list of registers to
be appointed by this act, the governor, by and with the
advice and consent of the Senate, if the Senate be in
session, shall proceed to fill such vacancy as soon as
may be after it occurs, and if the senate be not in ses-
sion, then the governor shall fill such vacancy, and it
shall be the duty of the registers, whenever any vacan-
cy takes place to report the fact immediately to his
excellency the governor.

SEC. 23. And be it enacted, That if either of said
registers shall bet, or be in any manner interested in
any bet or bets, on any election, or shall be stakehold-
er of any bet or bets, or shall, at any time, exhibit

SEC. 24. And be it enacted, That if any legal voter
shall arrive in the city of Baltimore, on the day of
election, and he shall prove, by indifferent testimony,
before any two justices of the peace of said city, that
he has been absent from the City or State, and had no
means of registering his name, and shall also prove
that he is otherwise entitled to vote under the consti-
tution and laws of this State, then, and in that case,
the judges of the election are authorized to have the
name of said voter entered on the register, and to re-
ceive his vote on his producing a certificate to that ef-
fect from the said two justices of the peace.
