CHAPTER 332.

CHAP 332.

A further additional supplement to an act, entitled, an
act to lay out and open a Road in Frederick and Bal-
timore counties.

1838.

WHEREAS, by an act passed at December session
eighteen and thirty-two, chapter one hundred and fifty-
eight, and by the supplements thereto, passed at De-
cember session eighteen hundred thirty-four, chapter
one hundred and ninety-five, and at December session
eighteen hundred and thirty-five, chapter fifty-nine,
commissioners were appointed to lay out and open a
road in Frederick and Baltimore counties; and where-
as, since the laying out and opening said road the
county of Carroll has been erected and created out of
that portion of Frederick and Baltimore counties
through which the said road passes, and it being rea-
sonable that the expense of laying out and opening said
road should be paid: — Therefore,

Preamble.

SECTION 1. Be it enacted by the General Assembly of
Maryland, That the Commissioners of Carroll county
be, and they are hereby required to levy upon the tax-
able inhabitants thereof, one-fifth of the amount expend-
ed in the laying out and opening of the said road, and

the Commissioners of Baltimore county and the levy
court of Frederick county be, and they are hereby re-
quired to levy upon the taxable inhabitants of the
counties of Baltimore and Frederick respectively, a
sum sufficient to defray the remaining four-fifths of
the expense of laying out and opening said road, agree-
ably to the provisions of the second section of the act
passed at December session eighteen hundred and
thirty-four, chapter one hundred and ninety-seven.

SEC. 2. And be it enacted, That the commissioners ;
of Baltimore and Carroll counties and the levy court
of Frederick county, be, and they are hereby required
to pay over the amount so levied to Benjamin Gorsuch,
Philip Nicodemus and Joshua Sellman, commissioners;
appointed to lay out and open said road, on or before
the tenth of January eighteen hundred and thirty-nine
and in default of paying the same, that the said
Benjamin Gorsuch, Philip Nicodemus and Joshua Sell-
