1837.

John Beard his executor; and that the said executor
refuses to pay over any part of said distributive share,
alleging as a reason that she cannot give him a valid
receipt for the same, she being a feme covert, and that
he has no certain knowledge of the death of her hus-
band, the said Mary Manning being without means of
support for herself and children: — Therefore.

CHAP. 297.

Be it enacted by the General Assembly of Maryland,
That the said executor, John Beard, is hereby autho-
rised and required to pay over to the said Mary Man-
ning the full amount of her distributive share of her
father's estate, by her giving him a receipt for the

elude Wesley Manning, or any other person in his
name, from recovering said distribution, or any part
thereof, from said executor.

CHAPTER 297.

An act to provide for the promotion of Justice, by a re-
sale of property in certain cases therein mentioned, in
Carroll County.

WHEREAS, Nicholas Kelly and Otho Shipley, by
their petition, in writing, have represented to this
General Assembly that a certain John Wier, of that
part of Baltimore county which now composes a part
of Carroll county, was indebted to them, the said Ni-
cholas Kelly and Otho Shipley, in certain sums of mo-
ney, for the recovery of which they had recourse to
law, and under writs of fieri facias, a house and lot
belonging to the said John Wier was exposed and sold
in eighteen hundred and thirty four, and a certain
Thomas Carr became the purchaser; and whereas, it

Appears by a certificate of Thomas Kell, clerk of Bal-
timore county, that a certain Henry Carter, a consta-
ble, then of the said county of Baltimore, returned a
schedule of the goods and chattels, lands and tene-
ments of John Weir, seized and taken by virtue of
five writs of fieri facias, issued by Joseph Steel, es-
quire, a justice of the peace of Maryland, in and for
Baltimore county, at the suits of Nicholas Kelly,
