CHAP. 225.

To locate and
open a road in
Montgomery.

SEC. 2. And be it enacted, That the said commis-
sioners for Montgomery county be, and they are here-
by authorised to locate and open a road in said county,
beginning at a point on the Westminster and Washing-
ton road, where the same is intersected by the road
leading from the town of Rockville to the city of Bal-
timore, to the county road leading to Brown's Ford.

One in Anne
Arundel.

SEC. 5. And be it enacted, That the said commission-
ers for Anne Arundel county, be, and they are hereby
authorised to open the road heretofore located and laid
out, leading from Brown's Ford aforesaid, to the Lime
Kilns in Anne Arundel county, and leading from thence
to the road from Snell's Bridge to Owens' Mills.

ty in obtaining

land therefor.

SEC. 4. And be it enacted, That if the commission-
ers aforesaid, cannot agree with the owner or owners
of the land through which the said roads may pass, for
the sale of the land, or the said owners shall be infants
or feme coverts, it shall be the duty of said commis-
sioners in their respective counties, before proceeding

to open the same, to apply to a justice of the peace of
said county, stating the facts in writing, and the said
justice shall issue his warrant to the sheriff of the
county in which the said lands lie, commanding him
to summon twelve disinterested freeholders of the
county to meet on the premises on some day named in
the warrant, at least twenty days after issuing the
same, and to summon the owner or owners to appear
on said day, and the said sheriff on the return of said
warrant, shall swear or affirm the said jurors so met,
on the premises, fairly and impartially to assess the
damages, if any, to be incurred by the location and open-
ing of said road, and the inquisition of the said jurors
so taken under their hands and seals, and the seal of
the said sheriff, shall be returned to the county court of
the county wherein the said lands lie, and the said
county court may affirm or set aside the said inquisi-
tion for excess or inadequacy of damages, and order
another, as to them shall seem fit.

Damages, costs
and charges.

SEC. 5. And be it further enacted, That the damages,
costs and charges of locating and opening said road in
the several counties aforesaid, shall be returned by the
commissioners of the respective counties aforesaid, to
the county commissioners of Anne Arundel county and
