CHAP. 191.
Public notice.

the board aforesaid shall cause public notice to be given
or such election at least ten days previous; and the nine
having the largest number of votes shall be declared
duly elected.

cy.

SEC. 4. And be it enacted, That at all times, and
forever hereafter, when any vacancy or vacancies shall
happen in the said community of trustees, by the death,
resignation, removal or the refusal to act of any one or
more of them, and in that case the remaining trustees,
or a majority of them, shall proceed to elect one or
more persons as the case may be, to fill up such vacan-
cy or vacancies to serve for the residue of the term,
and in like manner shall future vacancies be supplied
by the trustees and five of said board shall always he

SEC. 5. And be it enacted, That the said trustees,
and their successors. by the name and style aforesaid,
shall be capable in law to sue and be sued, plead and be
impleaded in any court or courts, and before any judge,
justice or justices within this State and elsewhere, in
all and any manner of suits, complaints, picas, causes,
matters and demands of whatsoever kind, nature or
form they may be, and all and every other matter or
thing to do therein in as full and as effectual a manner
as any person or persons, bodies politic or corporate
within this State, in like cases, may or can do and per-
form: and the said trustees, or their successors, or a
majority of them, shall have full power and authority
to have, make and use one common seal, with such de-
vice and inscription as they may think proper, and
therewith to pass and authenticate the certificates, acts
and order of the said corporation, said the same seal
to break, after and renew at pleasure.

SEC. 6. And be it enacted, That the said trustees
and their successors shall have power and authority to
appoint professors, teachers and assistants in said aca-
demy for instructing the students in such science and
branches of education as they may think proper and
