CHAP. 149.

Removal from
Ward.

of the ward where his name has been enrolled previ-
ous to the day of the election he shall retain his right
to vote in said ward, and in no other ward; provided

the name and number of the ward to which he has re-
moved, and that he is still a resident of Baltimore

SEC. 5. And be it enacted, That the registers ap-
pointed in the proceeding section of this act, shall set
for the purpose herein before mentioned; that is to say
to receive and register the names of such persons as
are entitled to vote under the provisions of this act.

be two dollars per day, to be paid out of any unappro-
priated money in the treasury.

Case of vacan-
cies.

SEC. 6. And be it enacted, That in case any vacancy
or vacancies shall occur in the list of Registers to be
appointed by this act, the Governor, by and with the
advice and consent of the Senate, if the Senate be in
session, shall proceed to fill such vacancy, as soon
as it may be after it occurs, and if the Senate he not
in session, then the Governor shall fill such vacancy,
and it shall be the duty of the registers, whenever any
vacancy takes place, to report the fact immediately to
his excellency the governor.

Penalty for neg-
lect of duty.

SEC. 7. And be it enacted, That if the said registers,
or any of them shall fail to perform the duties assign-
ed them in this act, or shall be guilty of any fraud in
the same, they shall be subject to a fine of five hun-
dred dollars, and imprisonment in the county Jail not
less than six months nor more than two years.

Voters absent,
arriving too
late to register.

SEC. 8. And be it enacted, That if any individual,
shall arrive in the city of Baltimore, on the day of
election, and he shall prove by indifferent testimony,
that he has been absent from the City or State, and
had no means of registering his name, and shall also
prove that he is otherwise entitled to vote under the
Constitution and Laws of this State, then and in that
case, the judges of the election are authorized to re-
ceive his vote.
