CHAP. 128.

by being desirous of renewing his petition, and of
again appearing before the said court, notwithstanding
such unfavorable decision; and it being deemed un-
reasonable that said debtor should remain in imprison-
ment whilst he is desirous of satisfying said court that
he has fairly surrendered up all the property that he
has been possessed of: — Therefore,

Insolvent laws
extended to.

be it enacted by the General Assembly of Maryland,
That the said Morris Malsby be, and he is hereby au-
thorised to prosecute a petition for the benefit of the
insolvent laws of this State, notwithstanding the un-
favorable decision heretofore made upon his former
petition, and that he shall have the same privilege with
respect to such petitioning anew, as he might or could
have had if his former application had not been refused
by said court.

CHAPTER 128.

1838.

An act for the benefit of the heirs at law of Richard
Beall, of Allegany county.

Preamble.

WHEREAS, a certain Jacob Hoblitzell, late of Alle-
gany county, in this State, departed this life, seized
in fee of certain lands, situate, lying and being in said
county; and whereas, said lands were sold, and a cer-
tain Richard Beall did make purchase of a portion of
said real estate; and whereas, said Beall hath also
departed this life, leaving one child, and Thomas J.
McKaig is the executor of said Beall: and whereas, a
certain William Lamar did purchase the life estate of
the widow of said Hoblitzell, and said Lamar hath al-
so departed this life, and it is greatly to the advantage
of the heir at law of the said Beall that she should
possess the entire interest in said estate: — Therefore,

Authorised to
purchase.

Be it enacted by the General Assembly of Maryland,
That the guardian of the said heir at law, be, and he
is hereby authorised to purchase said life estate in said
lands, for the use, benefit and advantage of the heir at
law of the said Beall, if the said purchase shall be
approved of by the orphan's court of Allegany county;
and the said purchase, when so made and approved of,
shall vest the title to said life estate in said heir at law.
