CHAPTER 295.

An act supplementary to an act, to incorporate the Upper
Marlborough Academy, in the Town of Upper Marlbo-
rough, in Prince George's County, passed December ses-
sion eighteen hundred and thirty-five, chapter two hundred
and forty.

WHEREAS, it has been represented to this General As-
sembly, that the Upper Marlborough academy might very
usefully and conveniently supply the place of a primary
school in the school district in which the said town of Up-
per Marlborough is situated, and that by making the said
academy a free academy, it would be necessary to erect a
primary free school in said school district — therefore,

Preamble.

SECTION 1. Be it enacted by the General Assembly of
Maryland, That it shall be the duty of the levy court of
Prince George's county, and they are hereby required to
levy annually, at their levy laying terms, upon the assessa-
ble property of said county, a sum of money payable to
the order of the trustees of said academy, equal to the
sum or sums levied or to be levied for the use of any other
free school in said county, under the provisions of the act
of Assembly, passed at December session eighteen hun-
dred and thirty-eight, chapter sixty-one, entitled an act,
supplementary to an act for the encouragement of prima-

levied, shall be collected as all other county charges now
are, and annually paid over to the said trustees by the col-

lector of the tax for said county, and shall be applied by
said trustees to the payment of the salary or salaries of the
teacher or teachers of said academy and other necessary
expenses thereof.

SEC. 2. And be it enacted, That in consideration of the
provisions of this act, if the trustees of the said Upper
Marlborough academy shall accept the same, the said
academy shall, from and after the first day of January,
eighteen hundred and forty-two, and forever thereafter, so
long as the said annual sum shall be so levied and recei-
ved by the said trustees, be to all intents and purposes a

free school or academy; and it shall and may be lawful, so
long as said annual sum shall be so levied and received by
said trustees, for the child or children of any citizen of
said county to be sent to and educated at said academy,
as free scholars, without charge, hindrance, molestation
