CHAPTER 248.

An act entitled, an act to authorise a Lottery to raise a
sum of Money to construct a Turnpike Road from
Hagerstown, Washington County, through Leitersburg
to the Pennsylvania State Line, and for other purposes
therein mentioned.

SECTION 1. Be it enacted by the General Assembly of
Maryland, That it shall and may be lawful for Robert M.
Tidball, Charles A. Fletcher, Lewis Zeyler, Samuel Ly-
day, William E. Doyle, Doctor Frederick Dorsey, Abra-
ham Strite and Joseph Gabby, or a majority of them, to
propose a scheme or schemes of lottery, the drawing of
such lottery to be completed at the expiration of all lot-

tery grants, to raise a sum of money, not exceeding thirty
thousand dollars, and to sell arid dispose the tickets
thereof; provided, the said Robert M. Tidball, C. A.
Fletcher, Lewis Zeyler, Samuel Lyday, William E.
Doyle, Doctor Frederick Dorsey, Abraham Strite and
Joseph Gabby, or such majority of them as shall under-
take to act under this law, shall before the disposal of any
ticket or tickets in said lottery, give their bond to the
State of Maryland for sixty thousand dollars, to be appro-
ved by one of the judges of Washington county court,
conditioned that they will, within three months after the
completion of the said drawing of said lottery, pay to
the Treasurer of the Western Shore of Maryland five per
cent. upon the sum raised, and well and truly apply so
much of the money arising from the sale of tickets in
said scheme or schemes within six months after the draw-
ing of said lottery shall commence, as will satisfy the for-

tunate adventures for prizes drawn by them; and after
deducting the necessary expenses incurred in said lottery,
shall, within three years from the completion of the
drawing of said lottery, cause the balance of the money
raised by said lottery, to be applied to the making of a
turnpike road from Hagerstown, through Leitersburg, to
the Pennsylvania line, and for introducing wholesome
water into the town of Leitersburg.

SEC. 2. And be it enacted, That Robert M. Tidball,
Charles A. Fletcher, Lewis Zeyler, Samuel Lyday, Wil-
liam E. Doyle, Doctor Frederick Dorsey, Abraham Strite,
and Joseph Gabby, or such majority of them, as may act
under this law, lodge in the clerk's office of Washington
county the bonds so as aforesaid to be given by them,
