CHAP. 224.

Provisoes.

ever, the said sale was in all respects bona fide made and

in pursuance of law; and provided further, that the said
court shall be satisfied that due notice of the application
for the ratification of said sale, was given to the defend-
ants in said case.

CHAPTER 223.

Passed Mar. 5,
1840.

An act extending the time for completing the Turnpike
Road from Boonsborough, in Washington County, to
Swearingen's Ferry, on the Potomac River.

Time extended

until 1845.

SECTION 1. Be it enacted by the General Assembly of
Maryland, That the time for completing the turnpike road
from Boonsborough to Sv,-earingen's feirv on the Potomac
river, in Washington county, be and the same is hereby
extended to the year eighteen hundred and forty-five, and
to the end of the next session of the legislature there-
after.

Rate of tolls.

Proviso.

SEC. 2. And be it enacted, That the president, direc-
tors and company of the said road, be and they are here-
by authorised to receive toll upon the whole of the said
road which is now completed and in public use, at a rate
not higher than is authorised by the original act of incor-
poration; provided, the raid road is kept by the said com-
pany in good condition and repair, according to the re-
quirements of the charter incorporating the said com-
pany.

CHAPTER 224.

1840.

A supplement to an act passed December session eighteen
hundred and thirty-six, chapter two hundred and sixty,
entitled an act for the relief of the heirs and devisees of
Doctor Elisha J. Hall, late of Baltimore, deceased.

Preamble.

WHEREAS, by an act of eighteen hundred and thirty-
six, chapter two hundred and sixty, Edward E. Hall and
Samuel T. Stonestreet, were appointed to sell and dispose
of certain property therein mentioned; and whereas, the
heirs of the said Doctor Elisha J. Hall, deceased, have
petitioned this General Assembly, that the name of Elisha
