CHAP. 217.

Seminary for the education of girls in the higher depart-
ments of science and literature, is much wanted in Freder-
ick city, and that individual contributions cannot be ob-

tained sufficient in amount to erect the necessary buildings,

and to purchase a suitable library and philosophical ap-
paratus; and whereas, education in all its departments is a
matter of public concern, and has received and ought to
receive the patronage and protection of the State, and
should be promoted when the means of the Slate will jus-
tify:— Therefore,

SECTION 1. Be it enacted by the General Assembly of
Maryland, That Alexander B. Hanson, William Tyler,
Lawrence Brengle and David Boyd, of Frederick county,
be and they are hereby appointed commissioners, with
full power and authority by a scheme or schemes of lot-
tery and the sale or sales thereof, and of the tickets therein,
to raise the sum of twenty thousand dollars, free and clear,
and over and above all expenses and charges, and which
said lottery shall be drawn in pursuance of the act of
eighteen hundred and thirty-five, chapter two hundred
and five, with the Maryland consolidated lotteries.

SEC. 2. And be it enacted, That the scheme or schemes
aforesaid shall be approved by the commissioners of lot-
teries, or any one of them, before the same, or any tickets
shall be deemed to be authorised to be sold; and that be-
fore the said commissioners may sell as aforesaid, they
shall enter into bond with sureties to be approved, and in
a penalty to be fixed by said commissioners of lotteries,
or any one of them, conditioned for the faithful discharge
of their duty as commissioners, and for the due applica-
tion for the purposes of this act, of the monies coming to

their hands as commissioners, which bond or bonds shall

be made to the State of Maryland, and filed in the clerk's
office of Frederick county court, and may on a certified
copy thereof as evidence, be sued as other public bonds
may, by any person or persons, or body politic, interested
in the condition thereof.

SEC. 3. And be it enacted, That the said commission-
ers appointed by this act may sell for such sums of mo-
ney as they may deem proper, the scheme or schemes
aforesaid, and the purchaser or purchasers thereof, and his
or their assigns, shall have and enjoy all the rights and
privileges in the disposal of the tickets in said schemes
and the raising money tberefrom, as are by this act conferred

on said commissioners; provided however, that such pur-
chaser or purchasers, or his or their assigns, shall so avail
