earth and sand, included within the lines of the lands con-
demned for the use of the said company, the president and
managers thereof, or any person duly authorised by them,
are hereby authorised and empowered to bargain and agree
therefor, and the owners thereof, or otherwise to procure
the same by condemnation by a jury in the same manner
as is provided and prescribed by the tenth section of this
act.

CHAP. 215.

SEC. 9. And be it enacted, That in consideration of
the making and keeping in good repair, by the company
hereby incorporated, a good and sufficient rail road, or a
substantial, firm and goodturnpike road, or the rendering
Deer creek in its natural course capable of being well and
conveniently navigated in dry seasons by vessels or boats
drawing not less than twenty inches water, and with pro-
perly constructed locks not less than ten feet wide nor less
than fifty feet long, for the easy passage of vessels as
aforesaid, or the providing a convenient navigation for

clause by means of a sufficient canal with locks as afore-
said, and of at least as great dimensions, the said works or
any work to be constructed or made by the said company,
for the objects of improvement authorised by this act, and
the appurtenances belonging to such work, are hereby ex-
empted from taxation for county purposes for the period of

may be lawful for the said company or their president and
managers at all limes afterwards, or after the completion
of any portion or section of their work, to erect and fix
so many gates, offices, depots, toll-houses and proper ap-
purtenances they may deem necessary, and to appoint
such and so many toll gatherers as they may think proper
to collect the tolls and duties hereinafter granted to the said
company; and it shall be lawful for the said company, or
its toll-gatherers,to demand and receive from every person
or persons using the said rail road, turnpike road, canal or
navigable way, either for travel or for transportation, con-
veyance or passing of any commodities, vessels, boats,
crafts, vehicles, beasts, or any bulk, weight or burden, such
tolls, duties and rates, as with respect to any like objects,
or similar thing subject to charge, are or may be allowed
to be demanded and received by any other company or
companies incorporated by this State, for the making of
