NOVEMBER. LAWS OF MARYLAND.

CHAP.
LXXI.

III. AND BE IT ENACTED, That any sale made by the commissioners named in this act shall be
notified to, and confirmed by, the orphans court of said county, before the conveyance of the pro-
perty shall be made, and bond, with good and sufficient security, in the name, of the state of Mary-
land, to be approved of by the orphans court of Montgomery county, shall be given by the persons
empowered to sell the lands as aforesaid, tor the due execution of the trust to them committed,
which bond shall be lodged with the register of wills for the county aforesaid, and the said bond
shall be recorded and be subject to be put in suit by any person or persons interested therein in the
same manner as administration bonds now are.

IV. AND BE IT ENACTED, That a deed executed by the said commissioners, or the survivor or
survivors of them, after the sale made by them of any of the lands shall have been confirmed by the
orphans court of Montgomery county, shall have the effect to convey all the right, title, claim and
interest, both at law and in equity, which he the said Lewis Bealmear had at the time of his death
in the land mentioned in the said deed to have been thereby bargained and sold, and shall be a bar
to any claim of dower by the said widow of the said Lewis Bealmear, or the right of any persons
claiming as his legal representatives, which deed or deeds, to be executed by the commissioners, shall
be acknowledged and recorded in the manner and within the time limitted by law. in the case of other
deeds,

An ACT for the benefit of Robert Herd, of Caroline County.

WHEREAS it is represented to this general assembly, by the petition of Levin Charles, and
Mary Charles his wife, of Caroline county, guardian of Robert Herd a minor, and son of
Joseph Herd, late of the county aforesaid, deceased, that on a division of the said Herd's estate
the said Robert Herd became possessed of a tract or parcel of land known by the name of Locker-
man's Purchase, alias Partnership, containing one hundred and thirty acres: And whereas it has
been represented that great advantages will arise to the said minor from the interest of the money
arising from the sale of said land; therefore,

II. BE IT ENACTED, by the General Assembly of Maryland, That the orphans court of Caroline
county shall have power and authority, on application of the said Levin Charles, and Mary Charles
his wife, on the part of the said minor, and being satisfied that it is necessary and will be an advan-
tage to the said Robert Herd, to order the sale of said land, upon such terms as the court may think
proper, and appoint a trustee or trustees for the purpose of effecting such sale; provided, that the
said land shall not be sold for a sum less than six dollars and fifty cents per acre.

III. AND BE IT ENACTED, That any sale made by authority of the orphans court of said county,
under this act, shall be notified to, and confirmed by, sard court, before the conveyance of the pro-
perty shall be made; a bond, with good and sufficient security, in the name of the state of Maryland,
to be approved by the orphans court of said county, shall be given by the person or persons empow-
ered to sell the land as aforesaid, for the due execution of the trust to him or them committed,
which bond shall be lodged with the register of wills for the county aforesaid, and the said bond
shall be recorded and be subject to be put in suit by any person or persons interested for and on be-
half of the said minor, in the same manner as administration bonds now are.

IV. AND BE IT ENACTED, That the trustee or trustees appointed by virtue of this act shall be
accountable to the guardian of said child, under the direction of the orphans court of said county,
and pay over the money arising from the sale of the land aforesaid, in such manner as the court
aforesaid shall or may direct, said guardian giving such further security as the orphans court may
deem necessary and require, for a due application of the said money for the benefit and interest of
said minor.

V. AND BE IT ENACTED, That any conveyance or deed made By the trustee or trustees aforesaid,
pursuant to the directions of the orphans court of the county aforesaid, shall and the same is hereby
declared to be valid and effectual to pass and convey all the right, title, interest and estate, of the
said Robert Herd, in and to the land aforesaid, to the purchaser or purchasers.

A Supplement to an Act, entitled, An Act for the benefit of the infant
children of James Wilson Perry, of Montgomery County, deceased.

BE IT ENACTED, by the General Assembly of Maryland, That the orphans court of Montgomery
county shall have full power and authority, in conformity with the provisions and upon the
