1838.

Sec. 34. And be it enacted, That the said managers
shall annually, on or before the first Monday of Febru-

ary, report to the General Assembly a statement of
the number of children taught, their ages and sexes,
the number of teachers employed, the condition of the
schools, and the amount expended for the purposes of
education, in each of the said election districts of Mont-
gomery county.

Sec. 35. And be it enacted, That all acts or parts
of acts inconsistent with this act, be, and the same are
hereby repealed.

herewith repealed.

An act to lay out and open a road in St. Mary's County.

Passed April 3,
1839.

SECTION 1. Be it enacted by the General Assembly of
Maryland, That the Commissioners of St. Mary's
county, are hereby authorized to appoint three com-
missioners, if they shall deem it necessary and proper
to do so, whose duty it shall be to survey, lay out. and
open a road, not exceeding in width thirty feet, com-
mencing at such point as the commissioners shall de-
termine upon, at or near the upper gate of the farm of
Jeremiah Alvey, through Samuel Maddox's farm, by
the place formerly railed "Green Springs, " then
through Richard Paynes or Hezekiah G. Hayden's
farm, as the commissioners may deem proper; and
from thence to the Wicomico River; and the said com-
missioners shall make out a plat of said road, and re-

turn the same to the commissioners of said county, to
be recorded among their records, and the said road
when so opened shall thereafter be deemed to be a
public road forever, and shall be kept in repair as such
in said county.

Sec. 2. And be it enacted, That the. expenses of sur-
veying and opening said road shall bo paid by the
county aforesaid, and Hie commissioners of said coun-

ty, are hereby authorized and required, on receiving

from the commissioners, an account, on oath, or said

expenses including an allowance of two dollars per
day for each commissioner, to levy the same on the as-
sessable property of said county.
