CHAP. 327.

Appointment and

duties of clerk.

Sec. 22. And be it enacted, That the said managers
shall appoint a clerk, who shall make oath, or affir-
mation, faithfully to discharge the duties of his office,
who shall make record of all their proceedings of said
managers, file and preserve all accounts examined and
passed, file all reports made to them, prepare and at-
test all orders on the treasurer, and do and perform
all other acts and duties, lawfully appertaining to his
office, and upon resignation, or removal, shall deliver
up to his successor, all books, papers and documents,
entrusted to his keeping, and failing to discharge any
of these duties, the said cleric shall pay the sum of fif-

ty dollars, to he recovered and appropriated in the
same manner as is hereinbefore directed and author-
ised in other cases of delinquency.

Powers and duties
of managers.

Sec. 23. And be it enacted, That the said managers

shall, each acting in his respective district, examine

all teachers, and dismiss any intemperate, cruel, neg-
ligent, or immoral teachers, at the end of any month,
adopt and cause to be put up in every school house, a
general system of rules and regulations, direct what
books shall he used, and what branches shall be taught,
visit every school at least once a year, suspend, or dis-
miss all pupils found guilty of incorrigibly bad con-
duct, establish primary schools for female white chil-
dren exclusively, where the same shall he. requested or
recommended by the trustees of any sub-district, ex-

ercise a general supervision and endeavour to promote

the full, equal and useful instruction of the youth of
said county.

Draft and pay over

school monies.

Sec. 24. And be it enacted, That the said managers,
each acting for his respective district, shall draw and
pay over to the said trustees for distribution, all mo-
nies coming, or property belonging to his said district,
and payment shall he made in all cases, by an order
or draft, upon the treasurer of the school fund of
Montgomery county, signed by said manager.

Teachers excluded.

Sec. 25. And be it enacted, That no commissioner,

manager, trustee, or clerk, during his continuance in

office, shall be a teacher, or contractor for building a
school house, or do any other work about the same,
for which he shall charge compensation.

Case of funds not

Sec. 26. And be it enacted, That if the whole, or
any portion of the monies due, or apportioned to any
