1838.

prong of the Andover branch with the main stream of
the Andover, or so far as a majority of the owners of
the low lands on said branch, may deem advantageous,
in such direction, and of such width and depth as they
or a majority of them may judge most proper to con-
vey the water from said branch and low lands, and it
shall and may be lawful for the said directors, or a ma-

jority of them, to meet on the first Monday in May, in
each and every year hereafter, at any place, or at any-
time or times, which may be agreed on by the said di-
rectors, or a majority of them, for the transaction of
business.

Annually to meet.

Sec. 2. And be it enacted, That the cost, charges
and expenses of cutting and opening said ditch or
drain, shall be paid by the respective proprietors of
the same, each paying for the cutting or opening the
drain through his, or her land, except when it shall so
happen that two or more of the said proprietors hold
parts of said branch, through which the said ditch or
drain shall be made, adjoining each other, in which
case, each shall pay in proportion to the part lie or she
shall or may hold.

Sec. 3. And be it enacted, That in case there are

any low lands on said branch which will be material-
ly benefitted by said ditch or drain, through which
the same does not run, then and in that case, the di-

rectors are authorized to appoint three commissioners
who shall view the same and award to what amount
the said low lands will be benefited by said ditch or
drain either in money or in work, and the same shall
be apportioned by the directors to the owners of said
land, through which the said ditch or drain runs,
agreeably to their respective portions.

Assessment thereof.

Sec. 4. And be it enacted, That the said directors, or
a majority of them are hereby authorized to apportion
what they may conceive the expences thereof may
amount to, for cutting said ditch or drain, and demand
and receive such proportion from the said proprietors
respectively, before or after the same is finished.

prietors, or any of them, shall not pay to said directors
his, her, or their respective proportion of any sum of
money fixed and apportioned by the said directors as
