turnpike road, and the president, managers and company, of the Baltimore and York-town turnpike
road, have, by their petition to this general assembly, prayed that the following explanations and
alterations be made in the charter or act of incorporation of said companies; and the prayer of
. their petition appearing reasonable and just, therefore,

CHAP.

cxxx.

II. BE IT ENACTED, by the General Assembly of Maryland, That all transfers of stock. in said com-
panies, executed either in person or by attorney, in the presence of the secretary of the said re-
spective companies, shall have the same effect and validity as if such transfers had been executed in
the presence of the president or treasurer of said companies respectively.

III. AND, whereas in making said new roads the beds of the old roads are frequently departed
from, and doubts are entertained whether the proprietors of the land through which such parts of
the old roads pass are authorised in shutting up the same; therefore, BE IT ENACTED, That where-
ever the new roads shall depart from the beds of the old roads respectively, it shall and may be
lawful for the justices of the levy courts for the several counties where such departure may exist, to
authorise the shutting up of such parts of the said old roads as shall be departed from by the said
new roads respectively, provided the same be wished for by the parties through whose lands such
parts of the said old roads may pass,

A Supplement to the act, entitled, An act for the valuation of the
real and personal property within this state.

Passed 20th of
January, 1808.

WHEREAS it is represented to this general assembly, that considerable delay and inconveni-
ence do arise from the late period at which the commissioners are directed to meet by the
original act to which this is a supplement; therefore,

Preamble.

II. BE IT ENACTED, by the General Assembly of Maryland, That the commissioners of the tax in all
the several counties of this state, may meet on the first Monday of April instead of the first Mon-
day of June.

CHAP. CXXXII.

Commissioners
may meet, &c.

An ACT authorising the commissioners appointed to superintend the
building of the state penitentiary to exchange with the justices of
the levy court for Baltimore county the property therein mentioned.

Passed 20th of
January, 1808.

WHEREAS it is represented to this general assembly, by the memorial of the said commissi-
oners, that it would highly promote the conveniencies of the said penitentiary if they were
authorised to exchange a part of the lot whereon the said penitentiary is erected, with the justices
of the levy court for Baltimore county, for a part of the county gaol lot, so as to reduce the same
more nearly to a square; therefore,

II. BE IT ENACTED, by the General Assembly of Maryland, That the said commissioners, and the
justices of the levy court for Baltimore county, be and they are hereby authorised and empowered,
to exchange such parts of the said lots of ground as the said commissioners and justices of the levy
court shall be of opinion ought to be exchanged, and the said commissioners and justices of the said
levy court are hereby authorised and empowered to sign, seal, execute, acknowledge, and procure
to be recorded, agreeably to the laws of this state, a deed of exchange for such parts of the said
lots of ground as shall be exchanged as aforesaid.

CHAP. CXXXIII.

An ACT to incorporate the New-Market fire company in the pre-
cincts of Baltimore.

Passed 20th of
January, 1808.

WHEREAS it is represented to this general assembly, by the president and members of the
New-Market fire company, in the precincts of the city of Baltimore, that they have pur-
chased a fire engine, and other apparatus, for the extinguishment of fire, and have obtained a lot of
ground from John Eager Howard for the purpose of erecting thereon a house for the reception of the
engine, and to be used for such other purposes as shall tend to promote the interest of the institu-
tion; and in order to secure the right and title to the said property, and to give effect to the laws,
rules and regulations, which have or may be established by the said company, it has been prayed
that an act of incorporation may pass in their favour; therefore,
