CHAP.

CXXVIII.

same, when collected, to pay over to the treasurer of their respective shores, to be appropriated
in such manner as any future legislature may direct.

Courts-martial
may acquit, &c.

XL. AND BE IT ENACTED, That each court-martial may acquit any delinquent by them to be
tried, upon its appearing to such court-martial that sickness, or some such sufficient excuse, was the
cause of the violation of the provisions of this act for which such person is called to trial.

Paymaster to
give security,
&c.

XLI. AND BE IT ENACTED, That before any paymaster shall act as such, he shall give bond and
security to the state of Maryland, to the satisfaction of the field-officers of the regiment or extra
battalion, as the case may be, to which he belongs, in the penal sum of one thousand dollars, condi-
tioned that he will, semi annually, submit to the field-officers of his regiment or extra battalion, as
the case may be, a full and fair statement of his accounts as paymaster as aforesaid, pay over all
balances remaining in his hands when demanded by his successor in office, or by the person authorised
to receive the same, and in all things faithfully discharge the duties of his office.

Money, how to
be appropri-
ated, &c.

XLII. AND BE IT ENACTED, That all money hereby directed to be paid into the hands of the
paymaster of the several regiments or extra battalions, shall be appropriated to the use of the re-
spective regiments or extra battalions in the following manner, to wit:, in the first place to defray
the necessary expenses of the regiment or extra battalion, and of the several companies composing
the same, and after such necessary expenses are discharged, then the balance to be applied by the
field-officers of the respective regiments or extra battalions to the purchase of muskets, and accoutre-
ments necessary thereto, which, when purchased, shall be distributed by the said field-officers,
among such persons in their respective regiments and extra battalions as are adjudged to be too in-
digent to purchase the same at their own expense; which said money in the hands of the said pay-
masters shall only be drawn therefrom by an order or orders, in writing, under the hands of the field-
officers of the regiment, or any two of them, or under the hands of the major and two captains of
an extra battalion, specifying the purpose for which the same is drawn.

Acts repealed,
&c.

XLIII. AND BE IT ENACTED, That the act of assembly, entitled, An act to regulate and dis-
cipline the militia of this state, and the supplement thereto, entitled, A supplement to the act, en-
titled, An act to regulate and discipline the militia of this state, be and the same are hereby repeal-
ed; provided also, that all commissions issued under the same be, and are hereby declared to be, of
the same force, validity and effect, as if the said acts of assembly had not been repealed, except such
commissions as shall, before the first day of July next, be revoked by the governor and council, who
are hereby authorised and empowered, at any time before that period, to revoke any commissions,
heretofore issued under the militia law of congress, or of the said militia laws of this state; and for
each commission issued by virtue of this law, the clerk of the council may receive twenty-five cents,
and to be paid by the person to whom the commission issued.

CHAP. CXXIX.

Passed 20th of
January, 1808.

Preamble.

An ACT investing the justices of the levy courts of the several
counties in this state with further powers.

WHEREAS it is represented to this general assembly, by sundry inhabitants of the state, that
errors have been committed by assessors, in consequence whereof many citizens have been
compelled to pay twice on the same property; therefore,

Court may rec-
tify errors, &c.

II. BE IT ENACTED, by the General Assembly of Maryland, That from and after the passage of this
act, it shall and may be lawful for the levy courts in the several counties of this state, and they are
hereby authorised and empowered, when they shall be satisfied that any error has arisen by assessing
property not liable to be assessed by any assessor, or in any other way, to rectify such errors, and
to levy and assess, in the same manner as ether county charges, any sum of money which any person
may have been charged with and paid in consequence of any such error, and to pay the said sum c£
money, so assessed, to the person, or his order, for whom the same was levied.,
