said board may approve of, conditioned for the faithful performance of his duty; and that the said
board cause a statement of the distribution of their premiums or medals to be published annually in
some news-paper in this state.

CHAP.
CLIX.

VII. AND BE IT ENACTED, That at all times hereafter when any vacancy or vacancies shall
happen in the said board of managers, the surviving or remaining managers, or any seven of them,
shall have full power and authority to fill up the same.

CHAP. CLX.

How vacancies.
are to be filled.

An ACT to Establish a market and to build a market-house in the
eastern precincts of Baltimore, and for the regulation of the same.

WHEREAS the erecting a market-house in the eastern precincts of the city of Baltimore, will
be attended with great convenience to the. inhabitants thereof, and to the inhabitants of Bal-
timore and other counties, and the same has been prayed for, the petition of a large number of sub-
scribers living in the city and precincts of Baltimore, and in Baltimore county; therefore,

January, 1808.

Preamble.

II. BE IT ENACTED, by the General Assembly of Maryland, That Hezekiah Price, Aquila Miles,
Thomas M'Elderry, Thomas Hillen, William C. Goldsmith, Arthur Mitchell and Daniel Conn, or
a majority of them, be and they are hereby appointed commissioners, for the time being, of the
market-house hereby to be erected, and as such shall have full power and authority hereby vested in
them, to receive from any person or persons a suitable lot of ground in the eastern precincts of the
city of Baltimore, in such situation as in the judgment of a majority of them shall be considered
as most eligible and convenient for a market-house, and to receive a deed or deeds therefor, exe-
cuted in due form of law, to them and their successors; and the right and title of the said lot of
ground, when conveyed as aforesaid, shall be, and the same is hereby declared to be, vested in the
said commissioners, and their successors, for ever, to hold, possess and enjoy the same, and the
market-house thereon, to and for the use and benefit of Baltimore, and the precincts thereof, in as
full and ample a manner as if the said commissioners had been legally constituted a body politic and
corporate, in deed and in name; and the said commissioners are hereby authorised and empowered
to erect and build a market-house upon the said lot so to be conveyed as aforesaid, and for that pur-
pose to contract for and purchase materials, and to contract and agree for the building of the same;
provided always, that the said commissioners, or a majority of them, shall, within sixty days after
obtaining the aforesaid piece of ground, enter into bond to the state of Maryland, in the penalty of
thirty thousand dollars, with condition that they the said commissioners, or a majority of them,
within two years thereafter, shall erect and build, or cause to be erected and built, a market house,
in a good and substantial workmanlike manner, according to such plan as the levy court of Baltimore
county shall approve, and shall finish and complete the same within the time heretofore prescribed;
which bond shall be lodged with the clerk of Baltimore county court for safe keeping, and upon such
bond, or office copy thereof, suit or suits may be instituted against the obligors therein named, for
any breach or non-performance of the condition thereof.

III. AND BE IT ENACTED, That to defray the expense of building said market-house, the said
commissioners, or a majority of them, be and they are hereby authorised and empowered to open
'books of subscription, and to receive subscriptions for the same, and the sums of money so sub-
scribed to collect and receive, and the same, when received, to expend in the erecting and building,
the market-house aforesaid.

IV. AND BE IT ENACTED, That after1 the said market-house shall be built, the days for -holding
the market thereat shall be, and the same are hereby appointed to be, on Mondays and Thursdays
in each week.

Market-days. -

V. AND BE IT ENACTED, That in case of the death, refusal to act, or removal from the city of
Baltimore, or precincts thereof, of any of the commissioners appointed by this act, that the levy
court of Baltimore county be and they are hereby authorised and empowered, to appoint a fit and
proper person to fill up such vacancy, and so from time to time to fill up such vacancies, that the
said commissioners may have perpetual succession for ever thereafter.

VI. AND BE IT ENACTED, That the commissioners of said market, or a majority of them, be and
they are hereby authorised and empowered, from time to time, to appoint a fit and proper person as
clerk of the said market, who, before he takes upon himself the execution of the said office, shall en-
ter into bond to the said commissioners, with two securities, to be approved of by the said commissi-
