The act authorizing the tide-water canal

   

company to issue toll notes, &c. passed

   

March session 1841,, chap. 47, repealed.

As a condition precedent to receipt, by

   

treasurer of the bonds mentioned in 1st and

   

second section and to the issue of any bonds,

   

&c. authorized by 3rd section, the Susque-

   

quehanna Canal Company and Tide Wa-

   

ter Canal Company, shall execute to trea-

   

surer mortgages, which shall be approved

   

by Attorney General, upon all their proper-

   

ty, &c. as security for payment of interest

   

and principal of the bonds in 1st and 2d sec-

   

tions mentioned and for payment by tide-wa-

   

ter canal company of interest and principal

   

of the bonds, &c. which may be issued un-

   

der the 3rd section, &c. said mortgages

   

shall contain covenants in all respects,

   

&c. with engagements, &c.

"

In rase of default in any respect, for the

   

sunender, if required, of all us works, &c.

Said mortgage executed by Susquehanna

   

Canal company to be recorded in the coun-

   

ty of York and county of Lancaster, Penn.

recorded, to be transmitted to treasurer.
