LAWS OF MARYLAND.

1843.

water, Charles Atkinson, George R. Curtis and William B.
Corbin, be and they are hereby appointed commissioners
to lay out and open a road in Worcester county, not ex-
ceeding thirty feet in width, beginning at a point in the road
leading from Neesaongo Bridge to Dividing Creek Bridge,
which shall be designated by said commissioners or a ma-
jority of them, and thence running from said point on the
straightest and best ground, to interset the county road lead-
ing from Neesaongo Bridge to Atkinson's mill at a point in
said road to be designated by said commissioners or a ma-
jority of them, which point shall be as nearly equi-distant
from said Neesaongo Bridge and Atkinson's mill as may be
consistently with the interest of all parties concerned, and
due economy in the construction of said road, and that the
said commissioners shall make out a plat of the road and
return the same to the clerk of Worcester county court, to
be recorded among the records of said county, and the said
road when so opened shall be deemed to be a public road
forever, and shall be kept in repair in the same manner as
all other public roads are directed to be kept up in said
county.

CHAP. 360

Sec. 2. And be it enacted, That if the commissioners
of Worcester county shall approve this act, they are hereby
authorised and empowered to levy upon the assessable pro-
perty of said county, a sum not exceeding one-third of the
amount which said commissioners appointed by this act
shall return upon their oath, to the commissioners of said
county, as the actual cost of said road, and the remaining
two-thirds of the cost of said road shall be paid by those
immediately interested, in such proportions as shall be
determined upon, due regard being had to the. interest and
means of all persons concerned, by the commissioners ap-

pointed by this act. Provided, that the commissioners or a
majority of them shall ascertain the damages that may be
sustained by any person or persons through whose lands
the said road may pass, taking into consideration the ad-
vantage and disadvantages to them, and the damages so
ascertained shall be considered as part of the actual cost of
said road.

Proviso.

Sec. 3. And be it enacted, That it shall be the duty of
the commissioners appointed by this act, to set up at public
sale to the lowest and best bidder, the contract for the con-
struction of said road, notice of the time and place of said
sale, shall be given by said commissioners, by notice set up
at two of the most public places in the neighborhood of
said road for at least three weeks preceding the day on
which said contract shall be set up for sale.
