chap. 276.

Seines, nets
&c. may be
seized.

Sec. 4. And be it enacted. That it shall be lawful for
any person or persons to seize any seine or nets attached
to such stakes or piles or the boats and materials used
therein, and any justice of the peace of the State of Ma-
ryland is hereby authorised upon proof exhibited betore
him of such seine boat or other article having been used
in fishing to condemn the same, and after such condemna-
tion and ten days public notice by advertisement in a
newspaper in the county or written advertisement set up
at three of the most public places in the neighbourhood,
such seine, boat or other article so used and condemned,
shall be sold to the highest bidder and alter deducting all
costs and expensts, the nett proceeds of such sale shall
be paid over to the person or persons seizing the same
and any person or persons resisting such seizure with
violence or injury to the person or persons attempting
such seizure shall be deemed guilty of assault and batte-
ry, and may be proceeded against in the usual forms of

such proceedings; provided however, that nothing con-
tained in this act shall be so construed as to extend to
any gilling seines or nets as are now usually anchored or
drifted in said waters.

appeal, &c.

Sec 5. And be it enacted, That any party or parties,
that may feel aggrieved by any judgment rendered by
any justice of the peace or magistrate s court, shall have
the right to appeal therefrom, to the county court, under
the same regulations and proceedings in relation to ap-
peals from judgments of justices of the peace as are now

provided by law, and provided, that nothing contained in
this act, shall be construed to debar any party of his said
right of appeal.

An act for the benefit of the securities of Frederick Wilion,
former Registsr of Wills for Kent county.

Securities au-
thorised to
make out list
of fees.

Be it enacted by the General Assembly of Maryland,
That the securities on the official bond of Frederick Wil-
son, former register of wills of Kent county, be and they
are hereby authorized to make out the list of fees due said
register at the time of his death, and to place the same in
the hands of the sheriff for collection, and the said sheriff
is authorized to collect the same in the same manner as
officer's fees are collected, and when collected, and after
