CHAPTER 171.

27, 1844.

An act to allow Thomas M. D. Baden, late collector of
Prince George's County, further time to complete his
collections.

Authorised to
collect

Section 1. Be it enacted by the General Assembly of
Maryland, That Thomas M. D. Baden, late collector of
Prince Georges county, be and he is authorised and em-
powered to collect any balances of taxes that may be due
the said Thomas M. D. Baden, in the same manner and

with the same power and privileges as are allowed by law,
provided, that if any person against whom there is a claim
by said Baden, for taxes as aforesaid, shall make affidavit
before any justice of the. peace of said county, that the
same has been paid the said Baden, shall not be authorised
to collect the same by execution in the manner now pre-
scribed by law, but the said affidavit shall not bar the said
Baden's right to collect said taxes as small debts are now

recovered by law.
Sec. 2. And belt enacted, That nothing in this act shall
be construed to effect the estate of any deceased person,
and that this act shall expire on the first day of January
eighteen hundred and forty-five.

 

CHAPTER 172.

27, 1844.

An act to amend an act to incorporate the Allegany Min-
ing Company, passed at December session eighteen hun-
dred and thirty-five, chapter three hundred and twenty-
six.

toll or tranpor-
tation as the
Rail Road.

Section 1. Be it enacted by the General Assembly of
Maryland, That from and after the passage of this act, it
shall and may be lawful for the Allegany Mining Company,
to charge, demand and receive for all persons and property
transported on the Rail Road, which they are authorised
to construct from their mines to the canal or other point, in
or near the town of Cumberland, the same rates of toll or
prices of transportation, as the Baltimore and Ohio Rail
Road Company are by law allowed to charge and receive.

Sec. 2. And be it enacted, That it shall not be necessary
for the said Allegany Mining Company, to construct their
said rail road, or any lateral way, from their said works or
mines to the basin of the said canal at Cumberland, but
