ceed to lay out and open the same, as effectually as if they
had possession of the original plat of said town.
Sec. 3. And be it enacted, That the expense of lay-
ing out and opening any of the streets and alleys in said
town be paid out of the funds of the said town not appro-
priated; or by the parties petitioning for the opening any
street or alley; at the discretion of the burgess and com-
missioners; but in no case any damages or expense shall be
allowed to the proprietor or proprietors of said town, or
their agents, caused by the opening of any street or alleys,
which they the said proprietor or proprietors, or their
agent, may have taken possession of and closed up, or caus-
ed to be taken possession of and closed up.

Sec. 4. And be it enacted, That the burgess and com-
missioners of the town of Jerusalem, shall not be authori-
zed by this act to open, or cause to be opened, any streets,
or alleys now closed in said town, unless by the consent
of a majority of the lot holders and citizens of said town
to be ascertained by petition in writing, and signed at least
by a majority as aforesaid..

CHAPTER 157.

 

An act to authorise the location of a Female school in the
town of Denton in Caroline county.

Passed Feb.
24, 1844.

Section 1. Be it enacted by the General Assembly of
Maryland, That William A. Tatem, James Turner, Nehe-
miah Fountain, George T. Martin, and Gaylord L. Moore,
be, and they are hereby constituted a board of trustees of
the Female School in Denton, Caroline county.

Sec. 2. And be it enacted, That the said board of trus-
tees, or a majority of them be, and they are hereby au-
thorised and empowered to locate and establish in the town
of Denton in Caroline county, a school for the education of
Females.

Sec. 3. And be it enacted, That the said school when
located shall be entitled to the same benefits, and subject to
the same rules regulations and restrictions, as the other
located schools in the middle district of Caroline county.

SEC. 4. And be it enacted, That in case of the death,
resignation, removal, or refusal to serve of any of the a-
forementioned board of trustees, the other members of said
board are hereby empowered to fill such vacancy or vacan-
cies by the appointment of others.
